PREAMBLE

The company Johanne Paris, hereinafter identified by the term "Johanne Paris," has established an online distance selling store on the site johanne-paris.com, henceforth called the "Online Store." This Online Store is accessible via the Internet and open to all users of this network, hereinafter referred to as "Internet users." It offers the possibility of selling its products, hereinafter referred to as the "Products," to Internet users who are final consumers and not professionals, when browsing the Online Store, hereinafter referred to as the “Users.” It is imperative to note that the acquisition of the Products with the aim of reselling them is not authorized. Consequently, Johanne Paris reserves the right to refuse any order for Products having the appearance of an intention of resale.

For the purposes hereof, it is agreed that the User and Johanne Paris will be collectively referred to as “Parties,” and individually as “Party.” The User who confirms an order will then be designated as a “Buyer.” The rights and obligations of the User necessarily apply to the Buyer.

Any order for a Product available on the Online Store implies consultation and explicit acceptance of these general conditions of sale, hereinafter called "General Conditions of Sale," without the need for a handwritten signature on the part of the User. . We therefore recommend that you read the General Conditions of Sale carefully with each new order placed.

Johanne Paris retains the right to modify the General Conditions of Sale at any time. In such a case, the General Conditions of Sale in force on the date of the order placed by the Buyer will apply.

ARTICLE 1: OBJECT

The General Conditions of Sale aim to define the terms of online sale between Johanne Paris and the Buyer of the Products offered on the Online Store.

The General Conditions of Sale take precedence over any other document, excluding in particular the general conditions of sale of the paper catalog of Johanne Paris, which are not applicable to distance sales.

ARTICLE 2. VALIDATION OF ORDERS AND ELECTRONIC SIGNATURE

Each order, validated by the User by means of a simple “click,” constitutes irrevocable acceptance of Johanne Paris’s offer. This acceptance may be called into question only in cases strictly defined by the General Conditions of Sale, such as the exercise of the “right of withdrawal” or in the event of “out of stock.” The “click” which accompanies the authentication procedure and guarantees the integrity of the messages takes on the nature of an electronic signature, which between Parties has the same validity as a handwritten signature.

The User has the possibility of canceling all or part of his order before validating the payment, whether the latter is deferred or immediate. The process of placing an order by the User is equivalent to total and unreserved acceptance of these general conditions of sale.

ARTICLE 3. PRODUCTS

The Products available for purchase on the Online Store are those presented at the time of consultation of the Online Store by the User. Johanne Paris sets out the characteristics of the Products in accordance with article L.111-1 of the French Consumer Code, thus offering the User the opportunity to familiarize themselves with the characteristics of the Products before finalizing their order. The Products offered for sale comply with current French legislation and the standards applicable in France. The images illustrating the products are not contractual in nature, and therefore, Johanne Paris cannot be held responsible in the event of inaccuracy or omission in any of the Product photographs.

ARTICLE 4. REGISTRATION AND VALIDATION OF THE ORDER

4.1. NAVIGATION WITHIN THE ONLINE STORE

The User has the possibility of discovering the various Products offered for sale by Johanne Paris on the Online Store.

The User can freely browse the different pages of the Online Store, without this resulting in an order commitment. During this navigation, the User can consult the essential characteristics of the different Products, their availability, their price, as well as the average delivery times offered, accompanied by their associated costs.

At any time, the User can click on the “Contact us” link to communicate with Johanne Paris electronically if necessary.

4.2. REGISTERING AN ORDER

The order must include the following information: nature of the Products selected by the User, description, quantities, availability, price, shipping costs incurred (including the average delivery time and delivery cost), as well as, where applicable, the costs relating to gift wrapping. The total amount of the order, all taxes included (TTC), including the selected shipping method and its cost, is also indicated.

4.3. CHECKING AN ORDER

Before finalizing their order, the User is asked to check all the information provided, in particular the Products, quantities, prices including tax, delivery costs and payment method. At this stage, the User has the option to complete or cancel their order.

The User is encouraged to read the General Conditions of Sale of Johanne Paris, in particular the withdrawal and return procedures, and has the possibility of consulting and/or printing them.

4.4. FINAL VALIDATION OF THE ORDER

In order to validate their order, the User must confirm to Johanne Paris that they have read the General Conditions of Sale and accept them. This validation is required to complete the order.

4.5. ORDER CONFIRMATION

A summary of the contractual information will be immediately sent to the Buyer by email, to the email address provided by the Buyer during the order process. This summary will include all the constituent elements of the contract between the Parties.

It is the Buyer's responsibility to verify the completeness and conformity of the information he has provided to Johanne Paris. Johanne Paris cannot be held responsible for any entry errors and their possible consequences in terms of delays or delivery errors. In such cases, all costs incurred for reshipment will be the responsibility of the Buyer.

ARTICLE 5. PROOF OF TRANSACTION

Computerized records, stored securely in computer systems, will serve as proof of communications and orders placed between the Parties. Purchase orders and invoices are archived in a reliable and durable manner, which can be presented as proof if necessary.

ARTICLE 6. PAYMENT

The amount owed by the Buyer corresponds to the amount indicated in the order confirmation sent by email to the Buyer.

6.1. ORDERS

For all orders, Johanne Paris accepts the following payment methods: Credit Card (CB), American Express and Paypal.

6.2. BEFORE ANY ORDER

Johanne Paris retains the right to suspend any order management and delivery in the event of refusal of authorization for payment by credit card from officially accredited organizations or in the event of non-payment.

Johanne Paris also reserves the right to refuse any order or delivery in the event of (i) ongoing litigation attributable to the Buyer, (ii) total or partial non-payment of a previous order attributable to the Buyer, or (iii) refusal of payment authorization by banking organizations. The buyer is informed that Johanne Paris cannot be held responsible for any fraudulent use of a means of payment which has not been detected. Full ownership of the Products sold by Johanne Paris remains reserved until full payment of all sums due by the Buyer for their order, including fees and taxes.

The transfer of ownership of a Product purchased from Johanne Paris to a third party is not supported by the Johanne Paris company. Only the original buyer of the property can invoke the provisions of the General Conditions of Sale and be a party to the sales contract.

ARTICLE 7. DELIVERY

7.1. NON-COLLECTION OF THE PACKAGE

The Buyer is responsible for collecting the package from the logistics provider within the specified timeframe following receipt of the delivery notice. If the package is not collected within the stipulated time, the package will be returned to Johanne Paris. The reshipment of the Products to the Buyer will be carried out at his expense, upon receipt by Johanne Paris of payment of the corresponding costs by check.

7.2. NON-CONFORMITY AND BREAKAGE

7.2.1. Incident upon receipt of the package:

Upon receipt of his order, the Buyer must check the conformity of the Products received in the presence of the delivery person. In the event of a problem regarding delivery (broken, chipped, missing product, damaged or missing package), the Buyer must:

  • Clearly notify reservations on the delivery note the same day of receipt, in the presence of the delivery person.
  • Inform Johanne Paris of the situation by email.

Any complaint made after this deadline or without reservations on the delivery note will be rejected, and Johanne Paris will be released from all liability.

7.2.2. Non-compliance of products with the order form:

The Buyer must notify Johanne Paris by email, on the same day of delivery or at the latest the first working day following delivery, of any complaint concerning a delivery error or non-conformity of the Products with the indications appearing on the purchase order.

ARTICLE 8. RIGHT OF WITHDRAWAL

Withdrawal period :

The Buyer has a period of fourteen (14) calendar days to return the Products he has ordered without reason, at his own expense. This period begins to run from the day following receipt of the Products by the buyer.

ARTICLE 9. COMPUTING AND FREEDOMS

NOMINATIVE INFORMATION

Johanne Paris attaches great importance to the protection of personal data. The collection of personal information in the context of distance selling is necessary to make online purchases, process and deliver orders, as well as to establish delivery notes. The information collected is processed and stored in accordance with the Data Protection Act n°78-17 of January 6, 1978 as amended and the General Data Protection Regulation (GDPR) which came into force on May 25, 2018.

ARTICLE 10. MISCELLANEOUS STIPULATIONS

10.1. FORCE MAJEURE

Neither Party will be responsible for non-compliance with its contractual obligations in the event of delay, hindrance or impediment due to a fortuitous event or a case of force majeure. Force majeure is considered to be all irresistible events or circumstances, external to the Parties, unforeseeable, inevitable, and beyond their control, and which cannot be avoided despite all reasonable efforts. The Party affected by such events will notify the other within ten working days of becoming aware of the situation.

The Parties will then meet, within one month, unless this is impossible due to force majeure, to assess the consequences of the event and agree on the terms of continued performance of the contract. If the force majeure lasts for more than three months, the General Conditions of Sale may be terminated by the injured Party.

Are expressly considered as cases of force majeure or fortuitous events, in addition to those usually recognized by French jurisprudence: the blocking of means of transport or supply, earthquakes, fires, storms, floods, lightning, interruption of telecommunications networks or problems related to telecommunications networks external to the Buyer.

10.2. PARTIAL INVALIDITY

If one or more provisions of the General Conditions of Sale are declared invalid pursuant to a law, a regulation or a final court decision, the other provisions will remain fully valid and effective.

10.3. ENTIRE CONTRACT

The General Conditions of Sale and the order summary sent to the Buyer form a complete contract and represent the entire agreement between the Parties. In the event of a conflict between these documents, the General Conditions of Sale will prevail. These General Conditions of Sale may be modified at any time by Johanne Paris. Any new version of the General Conditions of Sale will be accessible and indicated on the Online Store website. Any order will be subject to the general conditions of sale in force at the time of the order.

ARTICLE 11. INTELLECTUAL PROPERTY

All texts, comments, works, illustrations and images reproduced on the Online Store are the exclusive property of Johanne Paris and are protected by copyright and intellectual property, which prohibits any use without the authorization of Johanne Paris . Establishing commercial links in violation of the rights of Johanne Paris is strictly prohibited. Any total or partial reproduction of the Online Store is strictly prohibited. Any act in contradiction with this provision will be prosecuted.

ARTICLE 12. INFORMATION – COMPLAINTS

For any information, complaint or question relating to the conditions of sale of Johanne Paris, the site or the Products, the User must contact the Site's Customer Service by email.
